Information on the obligation to take back packaging material

According to the current Packaging Act, Section 15, Paragraph 1, Sentence 1 of the Packaging Act, we are obliged to take back the following packaging materials from end consumers free of charge:

Transport packaging, such as pallets, large packaging, etc.,
Sales and secondary packaging which does not typically end up as waste for private end consumers after use,
Sales and secondary packaging for which system participation is not possible due to system incompatibility according to Section 7 Paragraph 5, and
Sales packaging of goods containing harmful substances or
Reusable packaging.

Appropriate packaging material is used upon delivery of the product, which we take back free of charge. This ensures that the packaging material is returned to the recycling cycle. By providing information about return options, we aim to achieve better results in the recycling of packaging and contribute to meeting the European recycling targets according to EU Directive 94/62/EC.

As an end user, you can hand over the packaging material at the place of actual handover or in its immediate vicinity.

Conditions of Participation Dr.Clauder solution for pets GmbH

§ 1 Subject of the conditions of participation and organizer

(1) These terms and conditions govern the conditions for participation in the competition, as well as any necessary transfer of rights. The description and procedure of the respective competition will be published as part of the respective competition campaign on the Facebook page of Dr.Clauder solutions for pets GmbH (https://www.facebook.com/dr.clauders/).

(2) The organizer of the competition is Dr.Clauder solutions for pets GmbH, Auf dem Stemmingholt 41, D-46499 Hamminkeln.

(3) By participating in the respective competition, these conditions of participation are accepted.

(4) The competition has no connection with Instagram or Facebook and is neither sponsored, supported nor organized by Instagram.

§ 2 Participation

(1) Anyone aged 18 or over and residing in Germany is eligible to participate in the competition. Employees of Dr.Clauder solutions for pets GmbH and affiliated companies, as well as family members of such employees and their relatives, are excluded. Participation using false identities or the identities of third parties is not permitted. Multiple entries, as well as participation via automated mass processes or competition associations, are not permitted.

(2) Eligible participants can enter the competition by following Dr. Clauders' Facebook account, liking the post, and commenting on why their dog or cat should win the package. Participation is only possible via public Facebook and Instagram profiles.

(3) Participants agree that their post may be shared on the Facebook or Instagram account of Dr.Clauder solutions for pets GmbH (https://www.facebook.com/dr.clauders/ / https://www.instagram.com/dr-clauders/).

(4) The competition starts on Wednesday, May 14, 2025, at 8:00 a.m. and ends on Tuesday, May 20, 2025, at 11:59 p.m. (CEST).

§ 3 Prizes and prize notification test

(1) One package for dogs and one package for cats worth €80 RRP will be raffled off among all eligible participants on Dr.Clauder's Facebook and Instagram accounts.

(2) The winners will be randomly selected from among all eligible participants within 48 hours of the closing date. The winners will be notified via Facebook and Instagram and asked to send an email to the email address provided there, including their complete, correct, and truthful personal information. This information will be used to send the prize.

(3) If we do not receive an email from a winner within the specified deadline, the right to the prize expires. In this case, we are entitled to conduct a replacement drawing.

(3) Only one prize is possible per participant.

(4) The prize is neither transferable nor can the prize be exchanged or paid out in cash.

(5) If circumstances occur for which we are not responsible, the respective winner will accept an appropriate alternative prize.

(6) The prizes will be sent to the winner by mail to the address provided. Risk is transferred to the winner upon delivery of the prize to a carrier. We are not responsible for damage during delivery.

§ 4 Grant of rights of use, liability and indemnity

(1) By accepting the prize, the winner agrees that we may use his or her name for advertising purposes.

§ 5 Liability and Indemnity

(1) If the participant uploads photos, the participant guarantees that he/she will not send any content whose provision, publication or use violates applicable law or the rights of third parties.

(2) The participant indemnifies us against any and all third-party claims arising from the illegality of photos used by the participant. This indemnification obligation also includes the obligation to fully indemnify the organizer against legal defense costs (e.g., court and attorney fees).

(3) By participating in the competition, the participant releases Instagram from all liability.

§ 6 Exclusion

(1) A violation of these terms and conditions entitles us to exclude the respective participant from participation. This applies in particular if the participant provides false information or if content (e.g., comments) violates applicable law or the rights of third parties. The same applies to comments or contributions that could be considered violent, offensive, harassing, or degrading, or that otherwise violate social decency.

(2) If the excluded participant is a winner who has already been drawn, the prize may be revoked retroactively.

§ 7 Early termination and changes

We reserve the right to terminate the competition prematurely, in whole or in part, at any time and without observing any deadlines, or to change its course if it is not possible to guarantee the proper conduct of the competition for technical reasons (e.g. computer virus, manipulation of or errors in software/hardware) or legal reasons (e.g. prohibition by Facebook).

§ 8 Data Protection

We are responsible for the collection, processing, and use of participants' personal data, provided we process it ourselves. We will only use the participant's personal information and other personal data within the framework of the statutory provisions of data protection law. We will only store, process, and use the information to the extent necessary to conduct the competition or with the participant's consent. This also includes use to exercise the granted rights of use. The data will be used exclusively for the purpose of conducting the competition and will then be deleted.

Participants can request information about their personal data stored at any time. Otherwise, our privacy policy, which is available at https://www.dr-clauder.com/, applies accordingly.

§ 9 Final provisions

(1) Should the conditions of participation contain invalid provisions, the validity of the remaining conditions shall remain unaffected.

(2) German law applies. Legal recourse to review the drawing is excluded.
